I've gotten scratched pre-played games before, but considering how many I have bought, the percentage was very low, and the store was good about exchanging it for a working game. Personally, I don't mind receiving pre-played games for Christmas or birthdays. I think that most brand new games are over-priced anyway. A game is a game is a game, and since systems no longer use cartridges, there isn't the eerie experience of finding someone else's strange save-game (and Sims save-games can be strange, indeed) on your newly-bought game cartridge. :-) Some people think that giving people pre-played games as gifts is tacky. Normally it is nothing to worry about but check for a return policy because once you get it you may want to check for scratches from the previous owner. About 90% of the time you should be fine - I've never had any problems- but it is for a birthday so you may wanna make sure. (Unless of course it comes sealed in wrap again!)
